The terms for using tutortracer.com. If you are a customer, your use of the TutorTracer platform is governed by our Account Terms.
Looking for the terms that apply to TutorTracer customers? Read the Account Terms of Service at app.tutortracer.com/terms.
These Website Terms of Use (Website Terms) apply to your use of the website at tutortracer.com and its pages, including the website chat assistant and the forms for requesting a trial or demo (the Website). The Website is operated by Sheppard Corporation Pty Ltd (ACN 703 043 476) (“TutorTracer”, “we”, “us”, “our”).
By using the Website you agree to these Website Terms. If you don't agree, please don't use the Website.
These Website Terms do not govern the TutorTracer platform. Access to and use of the platform at app.tutortracer.com, the TutorTracer API, integrations and related services, including free trials and demo accounts, are governed by our Account Terms of Service (Account Terms), or by an Order Form or agreement signed with us.
If anything in these Website Terms is inconsistent with the Account Terms or a signed agreement in relation to the platform, the Account Terms or signed agreement apply.
The Website gives general information about TutorTracer. We try to keep it accurate and current, but features, pricing and availability change, and descriptions on the Website are not a promise that a feature is available to you or works in a particular way. The terms of your subscription are set out in the Account Terms and any Order Form.
Prices on the Website are in US dollars and exclude GST and other taxes unless stated otherwise. Nothing on the Website is legal, compliance, safeguarding or other professional advice.
The chat assistant on the Website answers questions about TutorTracer using an AI model. Its answers are generated automatically and may be incomplete or wrong, so please check anything important with us. Don't enter sensitive personal information, or information about students, into the chat. Messages are sent to our AI provider to generate a reply, as described in our Privacy Policy.
When you request a trial, you must give accurate details and be authorised to act for the organisation you name. Requesting a trial does not create a subscription. Trials are provided under the Account Terms, currently for 14 days or 400 lesson hours, whichever comes first, and we may decline or end a trial at our discretion.
Demo bookings are made through a third-party scheduling service (Google Calendar), whose own terms and privacy policy apply to the booking.
You must not:
The Website and its content, including text, graphics, product illustrations, logos and the TutorTracer name, are owned by or licensed to TutorTracer and protected by intellectual property laws. You may view and print pages for your own business evaluation of TutorTracer. Any other use needs our written permission.
The Website may link to or embed third-party websites and services, such as lesson platforms, scheduling tools and social media. We don't control them and aren't responsible for their content, availability or practices. Their own terms and privacy policies apply.
To the extent permitted by law, the Website is provided “as is” and we exclude all warranties about it, including that it will be uninterrupted, error-free or free of harmful components.
Nothing in these Website Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by law (including the Australian Consumer Law) that cannot lawfully be excluded or limited.
To the maximum extent permitted by law, we are not liable for any loss or damage arising from your use of, or inability to use, the Website or reliance on its content, including indirect or consequential loss, loss of profits or loss of data. Where our liability cannot be excluded but can be limited, it is limited, at our option, to supplying the relevant services again or paying the cost of having them supplied again.
Our liability to customers in connection with the TutorTracer platform is dealt with in the Account Terms or the relevant signed agreement, not in these Website Terms.
Our Privacy Policy explains how we handle personal information collected through the Website and the platform.
We may change these Website Terms at any time by publishing an updated version on this page and updating the “Last updated” date. The version published when you use the Website applies to that use.
These Website Terms are governed by the laws of Queensland, Australia. You and we submit to the jurisdiction of the courts of Queensland, and the Federal Court of Australia sitting in Brisbane, for any dispute about the Website.
Disputes between TutorTracer and a customer about the platform are resolved under the Account Terms. In summary, those terms are governed by Queensland law for all customers; customers whose principal place of business is in Australia resolve disputes in the courts of Queensland or the Federal Court of Australia sitting in Brisbane; and customers outside Australia resolve disputes by arbitration administered by the Australian Centre for International Commercial Arbitration (ACICA), seated in Brisbane, with hearings held by video conference unless the arbitrator decides otherwise. The Account Terms set out the full process, which starts with a good-faith attempt to resolve the dispute.
